The Entertainer Toy Shop Malaysia - Christmas Spend & Win Contest 2023
Terms & Conditions
1. This contest runs from 1st - 25th December 2023 at all The Entertainer Toy Shops in Malaysia and selected Early Learning Center stores located at Suria KLCC, Tropicana Gardens Mall, Sunway Pyramid Mall, East Coast Mall and Suria Sabah Mall only.
2. Permanent and/or temporary staff or employees of The Organizer which includes Kim Hin Joo (M) Berhad and Queemay Toys (M) Sdn Bhd are not eligible to participate in this contest.
3. Employee and immediate family members of the Organizers, their agencies, subsidiaries, and suppliers are not eligible to participate in the contest.
4. Eligible Participant must also meet these criteria: -
· Spend a minimum of RM250 in a single transaction at The Entertainer Toyshop or Early Learning Center stores located at Suria KLCC, Tropicana Gardens Mall, Sunway Pyramid Mall, East Coast Mall and Suria Sabah Mall.
· Redeemed the prize on the same day at the selected store as per transaction.
· By participating in this contest, the Eligible Participant agrees to be bound by these Terms and Conditions and the decisions of The Organizer.
5. Prize(s) may be subject to additional terms and conditions and it is the winner's responsibility to read and understand such terms and conditions.
6. Prize(s) are not redeemable for cash or exchange with any equivalent value goods or credit of any kind.
7. The Organizer reserves the rights at its absolute discretion to substitute any of the prizes with alternative prize(s) or any similar value prizes at their absolute discretion at any time without prior notice. The prize(s) are given on an "as is it" basis. All Prizes are non-transferable to another individual and absolutely non-negotiable.
8. No compensation in cash, refund, replacement or any kind shall be given to the Eligible Participants for any losses or damages suffered or incurred by the Eligible Participants as a direct or an indirect result of such variation, deletion, addition or alteration of these Terms and Conditions and/or the extension, modification, cancellation, suspension or termination of this contest.
9. The Organizer will not assume any responsibility for the Prize(s) offered under this Contest and accept no liability (including without limitation, loss of income, profits or goodwill, direct or indirect, incidental, consequential, exemplary, punitive or special damages of any party including third party) howsoever arising whether in contract, tort, negligence or otherwise in connection with this Contest, even if The Organizer have been advised of the possibility of such damages in advance, and all such damages are expressly excluded.
10. By acceptance or receipt of a Prize, the Winner agrees to hold harmless The Organizer and its affiliates and their respective directors, officers, employees and agents from and against any claim, action, proceeding, judgment, damage, loss, expense or liability suffered by The Organizer and its affiliates and their respective directors, officers, employees and agents in connection with such Winner’s participation in the Contest or receipt, redemption or use of the Prizes.
In the event, for any reason whatsoever, any of the Winners are unable to collect the winning prize within the stipulated time period, the Organizer shall not reimburse or compensate the Winner. The Organizer shall not be obliged to give extension notice of the Prize Collection/Redemption Period. All unclaimed Prizes after the stipulated Collection/Redemption Period will be forfeited.
11. The Organizer accepts no responsibility for any tax implications that may arise from the Prizes or the use thereof. Any tax filing obligation or any tax payment due to any authority as a result of receipt of the Prizes remain the sole responsibility of the participant. It is the responsibility of each participant to seek independent advice on the possible implications this may have on his/her own financial situation.
12. The Organizer reserves the right to publish or display the winner’s name, picture and city of residence of the Eligible Participants who won the prize(s) for this Campaign for advertising and publicity purposes in any manner it deems appropriate. By participating in this Campaign, the Winners hereby consent to and agree that The Organizer shall be at liberty to publish their names, pictures and city of residence without compensation for advertising and publicity purposes. Non-compliance may result in an alternative winner being chosen.
13. All transportation, accommodation, personal costs and/or any other costs, fees and/or related expenses that are incurred to participate in the Contest and to redeem the Prize is the sole responsibility of the Contestant(s) and/or Winner(s).
14. To the fullest extent permitted by law, the Organizer expressly exclude and disclaim any representations, warranties or endorsement, implied or express, written or oral, of all Prizes offered under this Contest. All risks, loss, damage and/or injury associated with the use of the Prizes shall be assumed by the Eligible Participants.
15. The Organizer will not entertain any complaint whatsoever in connection with the Prizes.
16. The Organizer may at its sole and absolute discretion alter, extend, terminate the Contest and amend the terms & conditions at any time without prior notice to any party.
17. Decision of The Organizer in relation to every aspect of this Contest shall be final, binding and conclusive.
